    Looks like Paris Hilton got caught on tape again.

    Just months after Hilton decreed that her share of the proceeds from her infamous sex tape, One Night in Paris, would be donated to charity, the saucy socialite is involved in a messy situation stemming from her own recent acquisition of said tape via an alleged five-fingered discount.

    Last month, Hilton was reportedly patronizing Swing News, a West Hollywood newsstand, where she made nice with a clerk and even agreed to have her picture taken while she shopped for magazines.

    But trouble broke out when the Simple Life star noticed that the newsstand was hawking her sex tape and advertising the fact with a large poster featuring her mug.

    "As soon as she saw that we were selling her videos and we had her on display she was livid. She was using profanity to the ultimate," store clerk Jerry Castro told Celebrity Justice.

    "She points to the poster and says 'Look at what the [expletive deleted] they're doing to me here. Don't you know my young fans come here all the time?' "

    In a surveillance video obtained by Celebrity Justice, a furious Hilton is shown trying to rip up the poster. She then reaches behind the counter and grabs a DVD, which Castro claims was One Night in Paris.

    "She threw her 80 cents change at me and took the video and said, 'I'm taking this and I'm not buying it,'" Castro recalled.

    Castro, who has since obtained an agent, declined to discuss the incident with E!. However, Jason Swing, the owner of Swing News, told E! he plans to press charges against Hilton.

    "She vandalized the newsstand, she disrespected the newsstand and stole from the newsstand, and that's not cool and I don't appreciate it," Swing says.

    Just goes to show you, hell hath no fury like a woman porned.

    As of Thursday afternoon, Los Angeles District Attorney had not determined whether to charge Hilton with a crime.

    Hilton, meanwhile, is in trouble on the other coast. The hotel heiress is in hot water for dropping an F-bomb while pulling duty at a fire station for the third season of The Simple Life. Apparently Hilton got on the dispatch system and said, "Ladder One, okay, sexy motherf-----s!"

    Because the expletive made it to the airwaves, Hilton could face a fine from the Federal Communications Commission. No word yet on whether the FCC will pursue the matter.

    Simple Life 3: Interns, featuring Hilton and sidekick Nicole Richie working as interns in various fields--though not in education--kicks off next Wednesday on Fox.

    I hope they do fine her. I'm a ham radio operator, and they are very strict about these types of violations. There have been cases where they triangulate a signal and bust someone who is breaking a FCC rule. You can't even let your car radio be overheard if you are operating in your car without risking a fine.

    So give Paris the same exact treatment they would give the little guy.

    These lame publicity attempts need to stop. Why not try getting in the news for, oh, I don't know, SOMETHING YOU'VE PUT ACTUAL, HARD WORK INTO?!!

    D.A. Rejects Hilton Theft Prosecution

    It was a videotape obtained exclusively by "CJ" that put Paris Hilton in the cross hairs of the Los Angeles County District Attorney. Security camera video from a Sunset Strip newsstand allegedly showed Paris Hilton ripping up a poster and ripping off a DVD of the X-rated video in which she appears.

    Now Paris can breathe a sigh of relief because "CJ" has learned that she will not be prosecuted. Sources in law enforcement tell "CJ" that the District Attorney has decided to reject the case "in the interest of justice."

    Jerry Castro was the clerk on duty at "Swing News," the newsstand in West Hollywood where the alleged rip-off went down. He was very upset when we told him that the D.A. had rejected the case.

    "Who does she think she is?" Castro asked. "What is the D.A. thinking that they're letting her get away with this?"

    The alleged newspaper-stand caper happened in mid December. In the surveillance video, Paris can be seen arriving by limo and examining magazines. Paris posed for pictures, but Castro claims she got angry when she spotted the X-rated video, "One Night In Paris," available for sale. Castro told investigators for the L.A. County Sheriff that Paris ripped up a promotional poster for the video. Castro claims that, after paying for several magazines, Paris then walked off with a DVD. "She threw her eighty cents change at me and took the video and said, 'I'm taking this and I'm not buying it,'" Castro told "CJ."

    The surveillance tape of the incident was shown on television programs around the world. The L.A. County Sheriff's Office recommended that Paris be charged with petty vandalism and misdemeanor theft. Sources tell us the case was reviewed at the "highest levels" of the D.A.'s office before the D.A. decided not to prosecute.

    "If it did go to trial it would be a circus trial," Santa Monica attorney Richard Hirsch told "CJ." Hirsch has defended many celebrity clients, and he says the District Attorney had legitimate reasons to reject the case.

    "She clearly didn't have the intent to go there and steal," Hirsch told us. "She paid for the other items that were there at the newsstand, and she saw this poster of herself in a compromising position at the newsstand and grabbed it impulsively."

    But Jason Swing, who owns "Swing News," says he could use a little "Celebrity Justice." "I'm disappointed," he said. "I'm almost speechless."

    Well, Snowy, it could be argued she DID put actual, hard... work... into making Paris.

    Now what happens if some average citizen comes along and steals her video from a newsstand? They'll throw the book at him! I just love having separate rules for the rich.

    Gee, but you know it would be a circus and a media frenzy at the taxpayers expense.
    Sometimes you just have to let things go. The cost of the trial with extra police would not be worth the fine and probation she would more than likely receive.
