Well, if the EIC of the French publication is to be believed, they already have these photos and refrained from publicizing them initially.

Closer just got fined for publishing the pictures of Catherine: Magazine fined for topless Kate photos - CNN.com

Nice that someoneis getting slammed for doing such a scummy thing.

I read somewhere that the photographer was the distance of FOUR football fields away when he took the pictures. I don't know if that's true, but if they were on the balcony of a private home 4,000 feet from any public road, I think there's a more than reasonable assumption of privacy there. The pictures were definitely grainy enough to have been taken from that distance. I highly doubt the guy just happened to see them and take the pictures. You don't use a lens that big unless you intend to take photographs from a LONG distance away. He knew he'd be taking pictures of them while they were on private property. IMO, that more than crosses the line of what should be acceptable.

I agree Critical, you don't use a lens that big unless you intend on taking photos to invade someone's privacy I also think Kate has learned a lesson.

Agreed. What kills me is that now Italian and Irish publications have also published the pictures. And they are all over the internet. It sends a message, the verdict, but it doesn't really help them. Just irritates me that the bad guys win, even if they have to pay something now. Seriously, did we learn NOTHING from Diana?

The statement that annoyed me the most came from a "journalist" in one of the countries where the pictures are being published. It was something to the effect of "She's not going to be OUR Queen." Basically, it didn't matter that the pictures were a hideous invasion of the privacy of a member of the royal family because it wasn't their country's royal family

    No, KatesMom.

NOTHING was learned from Diana's end. I believe that if that'd been the case, then --- even though those idiots had the photos --- they'd never have been published in the first place.

And yes, I agree with you that the bad guys are STILL winning. Having to pay the money means nothing to them, because they've reaped untold benefits in this circus through being the eye of the hurricane, if you will. The name of their magazine is being bandied about all over the world, and heaven only knows HOW many copies of that rag were sold before a verdict on the case came in.

Matter of fact, I even recall reading something earlier on about copies of that/those magazine(s) being offered for sale on eBay, at one time. From what I understand, eBay is now taking all those ads down and stopping the sales, but, there again, the damage has already been done.

And the bad guys STILL won.
